The Condom Mandate [Update]

An ordinance sponsored by the AIDS  Healthcare Foundation that requires LA porn productions to use condoms inorder to receive a film permit was tentatively approved last week by the Los Angeles City Council. Today a second vote gave the final approval. The law will go into effect in 90 days, at which point the LAPD can perform spot checks on permitted sets.

The Safer Sex in the Adult Industry Act will not affect films shot in studio. It applies only to permitted locations, like rented houses. I.e., it’ll apply to most sets. Though, I presume some will go guerilla style and film without a permit.

For a while now, the Cal/OSHA and AHF have interpreted a work-safety regulation already in the law books to mean unprotected sex on porn sets to be illegal. Before the passing of this new ordinance that interpretation was barely enforced.

The industry has been vocal on its anti-condom stance, which is disconcerting from an education and health perspective but sensible in a free-speech context.

In regards to health, self-regulation in the industry, such as requiring performers to have STD tests every month, has worked for many if not most. Over the decades HIV cases in the industry have been scarce. No doubt, requiring condoms would give performers the best protection. But it’s worth discussing wether a condom mandate is worth its implications.

∞ AIM (Adult Industry Medical) Healthcare Clinic Shuts Down [tinynibbles]

Violet Blue has the best coverage on the sudden closure of AIM, the porn industries’ go-to place for STI testing and healthcare before Monday.

There’s no official word from AIM, but reports point to bankruptcy and pressure from the Cal/OSHA and The Aids Healthcare Foundation (AHF) as contributors.

Talent Testing is a current alternative for testing, though they do not provide treatment. AIM alternatives and a union-type association are in the works.

Still, LAWeekly updates with news that the AHF has called for the Department of Public Health to enforce condom use on porn sets in AIM’s absence.

Sasha Grey Retires From Porn (Facebook statement to fans)

It’s become quite evident that my time as an adult film performer has expired. Don’t worry, I haven’t found Jesus. One thing is for certain, I’m proud to say I have no regrets, I genuinely feel I accomplished everything I could as a performer.

My hope is that Sasha Grey doesn’t stray too far from sex in art & entertainment, mostly because the world of sex needs positive role models.

About the “Porn Wikileaks” and AIM’s Database “Leak” [tinynibbles]

You know Porn Wikileaks, exposer of porn performers’ real names, is run by bigots out to smear pornography when each performer’s profile begins like this: “_______ is a pornographic whore and Hooker.” On their real name page Porn Wikileaks makes sure to let you know that these “Hookers” are ”degrading the whole family name.”

Their stated motivation is, “To get the gays out of straight porn and illegal gay pimps that have ruined porn and shut it down making condoms mandatory by the government now. The fag loving has got to stop. California is full of gay Mexicans and now they can even marry which is so wrong.”

Anyone who’s been tested at AIM is at risk of having their private information exposed. Follow link for help resources and more info.

Dot XXX approved

The .xxx top-level domain was approved by ICANN on Friday following years of failed attempts by the domain’s sponsor ICM Registry. .xxx is restricted to “adult sites” but is not mandatory.

The porn industry may be protesting about their financial losses (purchasing of domains to protect brands), but they’re correct on the free speech implications of a .xxx world.

Paul Cambria, industry attorney (via Xbiz):

“.XXX would afford a step toward content-based categorization of otherwise lawful speech. It would also provide a very convenient tool for those who have the power to either censor or prevent lawful speech to be disseminated.”

Like warning interstitials .xxx is a pointless move in an effort to give the prim false security. It’s misdirection: “Hey look. All the porn is over here at .XXX, easy to find but conveniently out of the way! ; )” Except it’s voluntary, so .com versions may slip through your filter. And on filter-less networks when little Johnny asks where all the porn is at, Sally says, “just tack on .xxx.”

Here’s how the Guardian ends their news story:

Use of the domain name is voluntary and is designed to shut out child porn and incorporate heightened security barriers, making it harder for children to stumble on sexual content online.

That is the exact PR ICM is using to defend itself: We’re protecting children from porn! The mainstream media needs to correct their stories to say “the domain name… is designed to make ICM money.” That’s the only reason .xxx exists. It fights child porn and hides sex just as well as a voluntary .religion domain would protect us from nutty extremists.

There is a real fear that this decision will lead to and inspire support for a .xxx mandate on every site considered “adult.” If this happens sites with even the slightest hint of eroticism or explicit commentary on sexuality will be in danger of unwarranted regulation.

Depressed that I still couldn’t find the red and cyan glasses I misplaced at twelve, I took a minute to make my own. Materials used: markers, clear tape, paper, and scissors. Though if you have more time to spare you can make something superior.

A quote from a PC WORLD article on the preliminary approval of the .xxx top-level-domain by ICANN:

ICM Registry, the company that proposed the dot-XXX domain, welcomed the vote.

“It’s been a long time coming,” ICM Chairman Stuart Lawley said in a statement, adding that he is “excited” by the move.

….

ICM Registry says it is a “completely independent entity with no affiliation, current or historic, with the adult entertainment industry.”

That claim of independence gave ICANN board member Rita Rodin Johnston pause for thought. “I still question whether, in fact, there is a real sponsored community here,” she said in the board-meeting debate before the vote.

Yet she and the rest of the board said “Eh, whatever. It’s a go.” The small group of people behind ICM are “excited” to profit off of the adult community, which they don’t represent, and which is not easily unified because “adult content” is not universally defined.

Currently, if implemented, a .xxx suffix won’t be mandatory for all “adult sites”. Though there’ll be financial pressure. ICM would have complete control over the amount they charge individual registrants. Further, .xxx would make it easier for oppressive governments to sanitize their people. The U.S. may actually be among the oppressors if  Senators Max Baucus (D-MT) and Mark Pryor (D-AR) get their way: force .xxx on sites harmful to minors.

.xxx makes as much sense as a .violence domain. Of course no politician is worried about giving blood and gore a cozy home on the internet.

The Free Speech Coalition satirizes ICM in the video below. It features a lot of big names from the porn biz, all opposing .xxx.
